The From Cursed to First! Sweepstakes Description

NO PURCHASE NECESSARY

 

The From Cursed to First! Sweepstakes sponsored by Be Fine Productions, Inc. allows you, the fan, to participate in a Sweepstakes to win two (2) prized tickets to a professional baseball game at Fenway Park in Boston, Massachusetts. Regular Season Prize will be tickets to a regular season professional baseball game on July 25, 2004 against the hated-ones from New York. In the event that the curse if broken, and the 2004 professional baseball championship series returns to Boston, the Post Season Prize will be tickets to one of the games held at Fenway Park. This Sweepstakes is open only to current residents of the United States who are 14 years of age or older.

The Sweepstakes for Regular Season Prize begins on Friday, March 26, 2004 at 3:00 P.M. (Pacific Time) and ends on Saturday, July 3, 2004 at 5:00 P.M. (Pacific Time).

The Sweepstakes for Post Season Prize begins on Friday, March 26, 2004 at 3:00 P.M. (Pacific Time) and ends at the conclusion of any game which results in the return of the professional baseball championship series to Boston’s Fenway Park.

Prizes

 

Regular Season Prize (1)

Two (2) tickets to a regular season professional baseball game to be held on July 25, 2004 at Fenway Park in Boston, Massachusetts. Approximate value of regular season prize is $80.00

 

Post Season Prize (1)

In the event that the 2004 professional baseball championship series returns to Boston, Post Season Prize will be two (2) tickets to one of the games held at Fenway Park. Approximate value of post season prize is $400.00 In the event that Boston does not qualify for the 2004 professional baseball championship series, no Post Season Prize will be awarded. Regular Season Prize Winner is not eligible to win the Post Season Prize.

 

Prize winners will be solely responsible for any and all expenses, including without limitation transportation, hotel, meals, gratuities or other expenses which may be incurred in connection with utilizing their prize. Prize winners must be at least 14 years of age.

 

No substitutions of prizes shall be permitted except in the sole discretion of the Sponsor.

How to Enter
Register in the The From Cursed to First! Sweepstakes sponsored by Be Fine Productions, Inc. by clicking at the end of the General Rules and following the entry instructions. You may only enter one time. You must be 14 or older to enter the sweepstakes. NO PURCHASE IS NECESSARY TO ENTER.

You also may enter by sending a self-addressed stamped envelope to: From Cursed To First Sweepstakes, Fullfilment Express Inc. 7271 Paramount Blvd. Pico Rivera, Ca. 90660. located at, which must be received by the entry deadline(s) for the Regular Season Prize and/or the Post Season Prize, as applicable.

 

Selection Criteria

The Regular Season Prize winner will be chosen from among all eligible entrants in a random drawing held on Saturday, July 3, 2004. All non-winning entries for the Regular Season Prize will be automatically entered into the random drawing for the Post Season Prize.

 

The Post Season Prize Winner will be chosen from among all eligible entrants in a random drawing held within 48 hours after Boston qualifies for the 2004 professional baseball championship. In the event that Boston does not qualify for the 2004 professional baseball championship series, no Post Season Prize will be awarded.

Odds of winning will be determined by the total number of fans participating in the sweepstakes. The random selection of winners and all other decisions by the judges shall be final and binding in all respects.

Winner Notification

Be Fine Productions will attempt to notify the Regular Prize Winner by e-mail on Sunday, July 4, 2004. Be Fine Productions will attempt to notify the Post Season Prize Winner by e-mail within 36 hours of after Boston qualifies for the 2004 professional baseball championship. In the event that Boston does not qualify for the 2004 professional baseball championship series, no Post Season Prize will be awarded.

The From Cursed to First! Sweepstakes sponsored by Be Fine Productions, Inc. rules set forth above, together with the General Rules shall be considered one document and together constitute the official rules of the Sweepstakes (collectively, "Official Rules"). By participating in this Sweepstakes, you agree to be bound by the Official Rules and by the judges' decisions on all matters which shall be final and binding on all participants.

GENERAL RULES

1. ELIGIBILITY

To become eligible to enter and win the Sweepstakes:

 

(i)         you must be a current legal resident of the United States;

 

(ii)         you must be 14 years of age or older at the time of entry; and

 

(iii)      you must NOT be an employee, consultant, director, officer, agent or representative of, or have a contractual relationship with Be Fine Productions, Inc., or be an immediate family member (mother, father, sister, brother, son, daughter or spouse) or any other member of the household of any such Ineligible Entrant..

 

Sponsor reserves the right, in its sole discretion, to disqualify any individual who is found to be: (i) tampering with the entry process or the operation of the Sweepstakes or the Web Site; (ii) in violation of the Terms of Service of the Web Site; (iii) acting in violation of these Official Rules; or (iv) acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person.

2. METHOD OF ENTRY

No Purchase is Necessary to Enter. Access the Web Site and complete the Sweepstakes entry form by completing the displayed fields. Any other attempt at Internet or e-mail entry is void. Any use of robotic, macro, automatic, programmed or like entry or play methods will void all such entries by such methods. No responsibility is assumed by any of the Be Fine Productions, Inc. for late, incomplete or misdirected e-mail or for any computer, telephone, cable, network, dsl, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, service provider/Internet/web site/user net accessibility or availability, traffic congestion, or unauthorized human intervention. Sponsor is not responsible, and is in no way liable, if you do not have a computer or Internet access; you may visit any one of the many free service providers, gain access to the Internet, and enter the Sweepstakes. In the event of a dispute as to the identity of the entrant, the authorized subscriber of the e-mail account used to enter the Sweepstakes at the actual time of entry will be deemed to be the Sweepstakes participant and must comply with these Official Rules. 3. NOTIFICATION AND OBLIGATIONS OF WINNERS

 

Sponsor will attempt to notify potential Regular Season Prize winner via e-mail on Sunday, July 4, 2004, at which time he or she also will be provided via e-mail with a Prize Acceptance Form to be signed by both the potential Regular Season Prize Winner and his or her guest (who must also be 21 years of age or older). Sponsor will attempt to notify potential Post Season Prize winner, if any, via e-mail within 48 hours after Boston qualifies for the 2004 professional baseball championship. It is your sole responsibility to notify Sponsor of any change in your e-mail, phone number or home address by sending an e-mail to sweepstakes@fromcursedtofirst.com. Be Fine Productions, Inc. shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason.

 

A potential Regular Season Prize winner will be disqualified, and forfeit any prize, if he or she: (i) fails to reply to Sponsors initial notification e-mail within 48 hours; (ii) fails to return to Sponsor or Sponsors designee Prize Acceptance Forms (or any other documentation required by Sponsor or its designee), signed by both the potential grand prize winner and his or her guest; (iii) is unable to travel on the dates selected by Sponsor, as applicable; or (iv) is otherwise ineligible to participate in the Sweepstakes. In such an event, an alternate prize winner will be selected utilizing the same selection and notification process used to select and notify the initial potential prize winner(s).

 

Winners may NOT elect to receive substitutes in lieu of prizes awarded; provided, however, a winner may waive his or her right to receive a prize. Prizes are non-assignable and nontransferable. Sponsor reserves the right to substitute prize(s) of equal or greater value if the specified prize(s) is (are) unavailable for whatever reason. Sponsor will be responsible for shipping charges, but all other Taxes, handling and delivery fees in excess of the prize amount, if any, are the sole responsibility of the prize winner. Winners are solely responsible for the reporting and payment of any federal, state and/or local taxes on prizes.

4. OWNERSHIP OF ENTRIES

Any communication or information transmitted to the Web Sites by electronic mail or otherwise is and will be treated as nonconfidential and nonproprietary. Entries become the exclusive property of the Sponsor and will not be returned. By submitting an entry, you hereby agree that Sponsor shall succeed to all right, title and interest in and to such submission and hereby irrevocably assign to Sponsor the exclusive right to copy, reproduce, publish (in all media now known or hereafter developed, including online media), edit, use, transfer, license or sell the Entry, or any part thereof, for all commercial or non-commercial purposes, in perpetuity, throughout the universe, on a royalty-free basis and at no charge to any of the Be Fine Productions, Inc..

 

5. USE OF NAME AND LIKENESS

 

You further grant permission to Be Fine Productions, Inc. for the use of your name and likeness for advertising, marketing and promotional purposes in perpetuity, throughout the universe, in all media now known or hereafter developed (including online media), on a royalty-free basis and at no charge to any of Be Fine Productions, Inc. (except where prohibited).

6. LIMITATIONS ON LIABILITY

You acknowledge and agree that Be Fine Productions, Inc., as well as their respective officers, directors, employees, representatives and agents, are not responsible for event cancellation or postponement, or for any claims, costs, injuries, death, losses, or damages of any kind arising from or in connection with:

(i)              you or your travel companions participation in the Sweepstakes and/or the use or misuse of any prize (including, without limitation those related to personal injuries, death, damage to, loss or destruction of property);

 

(ii)             you or your travel companion’s rights of publicity or privacy, or any claim that you somehow have been defamed or portrayed in a false light;  

 

(iii)            any incorrect or inaccurate information, whether caused by web site users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Sweepstakes;

 

(iv)            any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Web Site;

 

(v)             any injury or damage to your computer (or to any other third parties computer) related to or resulting from your participation in this Sweepstakes or downloading materials from or use of the Web Site(s); or

 

(vi)        your access to and use of the Web Site(s) or the downloading from and/or printing material downloaded from the Web Site(s).

By entering the Sweepstakes, you agree that: (1) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, if any, but in no event will attorneys' fees be awarded or recoverable; and (2) under no circumstances will you be permitted to obtain any award for, and you hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out-of-pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased.

Without limiting the foregoing, everything on the Web Site is provided "as is" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow the limitations or exclusions set forth above, so some of the above limitations or exclusions may not apply to you. 7. GOVERNING LAW AND JURISDICTION

As a condition of entering the Sweepstakes, you agree that any and all disputes arising out of or connected with this Sweepstakes (including without limitation the construction, validity, interpretation and enforceability of these Official Rules), shall be resolved individually, without resort to class action, and shall be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions. You irrevocably agree that the State and Federal Courts located in Los Angeles, CA shall have exclusive jurisdiction over any suit or other proceeding arising out of or based upon this Agreement, and you hereby waive any claim that you are not subject to the personal jurisdiction of said courts, or that any such suit or other proceeding is brought in an inconvenient or improper forum or venue. As a condition of entering the sweepstakes you agree to allow From Cursed To First .com to contact you via email regarding updates, and other information including sales and giveaways.

8. RESERVATION OF RIGHTS

If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical problems, failures or malfunctions, or any other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, could destroy, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, in its sole discretion, to modify the scheduling, cancel, terminate, modify or suspend the Sweepstakes.

9. SEVERABILITY

 

The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

Entry in the Sweepstakes does not constitute entry into any other promotion, Sweepstakes or sweepstakes.
